SUBSEQUENT

YEARS
.--Payment rates in years after the

year of implementation of such system shall
3
be the payment rates in the previous year
4
increased--
5
``(I) in the first year after imple-
6
mentation of such system, by the per-
7
centage increase in the MEI (as de-
8
fined in section 1842(i)(3)) for the
9
year involved; and
10
``(II) in subsequent years, by the
11
percentage increase in a market basket
12
of Federally qualified health center
13
goods and services as promulgated
14
through regulations, or if such an
15
index is not available, by the percent-
16
age increase in the MEI (as defined in
17
section 1842(i)(3)) for the year in-
18
volved.

REPARATION FOR PPS IMPLEMENTA

.--Notwithstanding any other provision of
21
law, the Secretary may establish and implement
22
by program instruction or otherwise the payment
23
codes to be used under the prospective payment
24
system under this section.''.
