.--The term `biologi-

cal product' has the meaning given such term in sec-

tion 351 of the Public Health Service Act.

DEVICE
.--The terms `drug' and `de-

vice' have the meanings given such terms in section

201 of the Federal Food, Drug, and Cosmetic Act.

``(3) H
IGH NEED CURE
.--The term `high need

cure' means a drug (as that term is defined by section
18
201(g)(1) of the Federal Food, Drug, and Cosmetic
19
Act, biological product (as that term is defined by sec-
20
tion 262(i)), or device (as that term is defined by sec-
21
tion 201(h) of the Federal Food, Drug, and Cosmetic
22
Act) that, in the determination of the Director of
