.--For purposes of

this section, the term ``annual payment date'' means

with respect to any calendar year the date determined
3
by the Secretary, but in no event later than Sep-
4
tember 30 of such calendar year.

N GENERAL
.--With respect to each covered

entity, the fee under this section for any calendar
8
year shall be equal to an amount that bears the same
9
ratio to $2,000,000,000 as--

(A) the covered entity's gross receipts from
11
medical device sales taken into account during
12
the preceding calendar year, bear to
13
(B) the aggregate gross receipts of all cov-
14
ered entities from medical device sales taken into
15
account during such preceding calendar year.

ROSS RECEIPTS FROM SALES TAKEN INTO

ACCOUNT
.--For purposes of paragraph (1), the gross
18
receipts from medical device sales taken into account
19
during any calendar year with respect to any covered
20
entity shall be determined in accordance with the fol-
21
lowing table:
