``(1) the development of the CLASS Independence

PPLICATION OF
FACA.--The Federal Advisory

Committee Act (5 U.S.C. App.), other than section 14 of

that Act, shall apply to the CLASS Independence Advisory

Council.

UTHORIZATION OF
A
PPROPRIATIONS

``(1) I
N GENERAL
.--There are authorized to be
11
appropriated to the CLASS Independence Advisory
12
Council to carry out its duties under this section,
13
such sums as may be necessary for fiscal year 2011
14
and for each fiscal year thereafter.

``(2) A
VAILABILITY
.--Any sums appropriated
16
under the authorization contained in this section
17
shall remain available, without fiscal year limitation,
18
until expended.

``SEC. 3208. SOLVENCY AND FISCAL INDEPENDENCE; REGU-
20
LATIONS; ANNUAL REPORT.

.--The Secretary shall regularly con-

sult with the Board of Trustees of the CLASS Independence
23
Fund and the CLASS Independence Advisory Council, for
24
purposes of ensuring that enrollees premiums are adequate
