``SEC. 2046. RULE OF CONSTRUCTION.

``Nothing in this subtitle shall be construed as--

``(1) limiting any cause of action or other relief
3
related to obligations under this subtitle that is avail-
4
able under the law of any State, or political subdivi-
5
sion thereof; or
6
``(2) creating a private cause of action for a vio-
7
lation of this subtitle.''.

(A) I
N GENERAL
.--Section 402(a)(1)(B) of

the Social Security Act (42 U.S.C. 602(a)(1)(B))
13
is amended by adding at the end the following
14
new clause:
15
``(v) The document shall indicate
16
whether the State intends to assist individ-
17
uals to train for, seek, and maintain em-
18
ployment--
19
``(I) providing direct care in a
20
long-term care facility (as such terms
21
are defined under section 2011); or
22
``(II) in other occupations related
23
to elder care determined appropriate
24
by the State for which the State identi-
